Nuvio, Inc. (“we,” “us,” or “Nuvio”) is currently developing the Nuvio One Mobility Product (the “Nuvio One”). While the Nuvio One is not yet available for purchase, we are currently accepting reservation fees in the amount as set forth on the NuvioMobility.com purchase page (the “Reservation Fee”). In consideration for payment of the Reservation Fee, you will be placed on a waitlist and notified on a priority basis once the Nuvio One is available for purchase. To the extent you exercise your right to purchase a Nuvio One at that time, the Reservation Fee will be applied to such purchase, and such purchase will be at the price as set forth on the NuvioMobility.com purchase page at the time of your payment of the Reservation Fee.

Your credit card will be charged in the amount of the Reservation Fee at the time of payment, and you will receive an acknowledgment of your reservation via email at that time.

Payment of the Reservation Fee does not guarantee the availability of a Nuvio One. When the Nuvio One is ready for sale all individuals who pay a Reservation Fee will be notified of availability at the same time, and purchases of the Nuvio One will thereafter be processed on a first-come, first-served basis, subject to availability. When available, if you agree to purchase a Nuvio One, your Reservation Fee will be applied to that purchase at that time. To the extent that any individual pays a Reservation Fee is not able to purchase a Nuvio One upon its initial release due to availability, those individuals will again be notified on a priority basis as set forth above as additional Nuvio Ones become available, until such time as all individuals who have paid a Reservation Fee have had the opportunity to purchase a Nuvio One.

You may cancel your reservation at any time by notice to Nuvio at [[email protected]]. Nuvio may also cancel your reservation at any time. Whether canceled by you or by Nuvio, your Reservation Fee will be refunded in full to your original payment method within 30 days of such cancelation. If you wish to have your Reservation Fee refunded via a different payment method, please contact Nuvio at the email address above, provided, however, that Nuvio reserves the right to request such additional information as is required, in Nuvio’s discretion, to confirm your identity prior to issuing a refund.

Nuvio cannot guarantee when the Nuvio One will be available, what quantities will be available, and whether additional limitations on availability might apply. You further understand that we have not completed the development of the final Nuvio One product or begun manufacturing of the same, and that specifications are therefore subject to change before the Nuvio One is available for purchase.

ADDITIONAL TERMS AND CONDITIONS OF PURCHASE WILL APPLY AT THE TIME OF SALE, AND NUVIO MAY TERMINATE ANY INDIVIDUAL RESERVATION, THE ACCEPTANCE OF NEW RESERVATIONS, OR THIS RESERVATION FEE POLICY AT ANY TIME, FOR ANY REASON OR NO REASON.
